Planet Fitness is a Trademark in Alberta, Canada and holds common-law trademark rights to PLANET FITNESS within a specific geographic area. The boundaries of this area can only be established by a court. Planet Fitness reserves the right to seek and execute a declaration from the courts to grant Alberta, Canada as the said territory. Planet Fitness rights are enforceable through actual use of the mark throughout Canada generating much reputation and goodwill. Section 17 ( 2 ) of the Canadian Trade-marks Act also protects Planet Fitness. Planet Fitness may seek to expunge the said trademarks under this section. It may be established that the person who adopted the registered trade - mark in Canada did so with knowledge of that previous use of marking known.
